General terms and conditions Wedding Photography.
By making an appointment, the bridal couple agrees to the following general terms and conditions.
Article 1: Photographer
MarcellaFotografie will provide the wedding reportage of the bridal couple with professional and backup equipment. MarcellaFotografie will be present at the locations on time and will not leave earlier than agreed upon.
Article 2: Execution of the assignment
MarcellaFotografie will execute the assignment to the best of her ability, in the style in which she usually works.
MarcellaFotografie delivers the images in her own style.
Article 3: Down payment
MarcellaFotografie requests a down payment of 500 Euros upon reservation of the wedding date.
This down payment must be paid within 14 days after sending the invoice. If the down payment has not been made after this date, the assignment may be declared void.
MarcellaFotografie delivers her products after the full payment has been received.
Article 4: Payment terms
All amounts are inclusive of VAT, unless otherwise agreed.
MarcellaFotografie will send the amount due in an invoice to the bridal couple.
The bridal couple has a payment term of 14 days after the invoice date.
Article 5: Products and delivery
MarcellaFotografie sends an online gallery within 72 hours after the wedding day, containing 20 to 30 edited photos.
MarcellaFotografie delivers the number of photos described in the package.
MarcellaFotografie delivers her files digitally.
MarcellaFotografie does not deliver RAW files.
MarcellaFotografie has an estimated delivery time of 6 to 8 weeks.
Article 6: Copyright and privacy
The copyright of the photos always belongs to MarcellaFotografie. The photos may be freely used by the bridal couple, subject to consultation for commercial use.
The photos may not be further edited by the bridal couple.
MarcellaFotografie will never disclose or pass on personal data to third parties.
Article 7: Cancellation and suspension
If an invoice is not paid within the payment term, MarcellaFotografie, after informing the client, may suspend all her activities for the client until the amount of the invoice is paid.
In case of cancellation of the agreement by the bridal couple, the bridal couple will not receive a refund of the down payment.
If MarcellaFotografie's safety is not adequately guaranteed or in case of improper use of the materials provided, MarcellaFotografie is entitled to deviate from the already concluded agreement at her own discretion, or to dissolve it entirely or partially at the expense of the negligent party.
If the client cancels an agreement in whole or in part, the costs incurred by MarcellaFotografie as a result of this cancellation shall be reimbursed in full by the client, with a minimum of 50% of the agreed amount in case of cancellation up to 1 week before the wedding day; and 100% of the agreed amount in case of cancellation in the last week before the wedding day or on the day of the wedding.
Article 8: Illness
In case of serious circumstances or illness preventing MarcellaFotografie from executing the assignment herself on the agreed date, she will send a photographer who works in the same style as her. The photos will always be finished by MarcellaFotografie.
Article 9: Portrait rights
MarcellaFotografie reserves the right to use the images for her own promotional purposes and publications, including (but not limited to), the website and weblog, portfolio, social media, and printed matter.
MarcellaFotografie may use photos for photo competitions and publications in magazines.
Deviating agreements will be documented via email or in writing.
Article 10: Changes to these general terms and conditions
MarcellaFotografie reserves the right to amend or supplement these general terms and conditions.
Changes will be communicated in a timely manner by MarcellaFotografie to the bridal couple.
